So, I heard this on NPR this morning: Ohio, Kentucky Feuding Over Rock In A Hard Place

Are states truly so hard up for tourism dollars that they are actually calling this theft of antiquities? It's not just for Greece and Italy anymore. . .
So my questions here are:
a) Is it theft? (i.e. who has provenance here?)
b) Is it an antiquity?
